This insurance document (the Insurance) gives information about the Insured parties and the Insured Equipment which is covered under this insurance and other relevant terms and conditions.
Insured: Axiom Telecom
Beneficiary/User: the purchaser, whose name is as shown on the relevant invoice. In addition, his / her spouse and children may use the Insured Equipment. Where the purchaser is a company, the beneficiary/user shall mean any representative / employee of the company authorised to use the Insured Equipment.
Insured Equipment: the product as shown on the relevant purchase invoice, including Laptops, Mobile Handsets, Tablets (both voice & data) and Cameras.
Insured Outlet: Axiom Stores, Fono, One Mobile, Next Mobile, Corporate clientele of the Insured (including the subsidiaries of the Insured).
Insured Website: http://www.axiomtelecom.com/
Program Administrator/Coordinator: GAS (Global Assurance Solutions) and its associate Global Assurance Services.
Cover Period: 12 months from the date of purchase of the Insured Equipment.
Purchase Price: the Insured Equipment value as mentioned in the relevant purchase invoice.
Sum Insured: Insured Equipment value as mentioned in the relevant purchase invoice.
Covered Territory: UAE, Oman, Qatar, Bahrain, Kuwait, and Saudi Arabia(applicable in country of purchase only).
Provided the Beneficiary/User has purchased the equipment from an Insured Outlet or Insured Website and a purchase invoice is issued to the Beneficiary/User along with this Insurance, the Program Administrator/Coordinator, on the occurrence of any of the following events, will approve for repair or replacement, equipment the same or similar to the Insured Equipment, subject to the terms and conditions of this Insurance, provided the Insured has declared the purchase of the Insured Equipment to the Program Administrator/Coordinator and has paid the appropriate premium:
If the Insured Equipment-
Suffers any sudden and accidental physical damage to the exterior or internal components as a result of external impact and such damage causes the Insured Equipment to stop working; or
Fails to work because fluid has entered its internal circuitry, resulting in the non-function of the Insured Equipment.
For the avoidance of doubt, the Insured will not be eligible for any compensation under this Insurance for any loss or damage to accessories of any kind, even if forming a part of standard pack or to any complimentary or ancillary product/s, made available under any promotional scheme at the time of purchase.
This Insurance may be terminated within 7 days of purchase of the Insurance at the request of the Beneficiary/User in writing, in which case the customary short period rate for the time the Insurance has been in force will be retained and provided there has been no claim under the Insurance from the date of inception of risk.
This Insurance may also be terminated at any time at the option of the Program Administrator/Coordinator or notice to that effect being given to the Insured in which case the Program Administrator/Coordinator shall be liable to repay on demand a rateable proportion of premium for unexpired term of the Insurance from the date of cancellation.
Governing Law and Dispute Resolution
This Insurance shall be governed by the law of the country in the Covered Territory where the Insured Outlet where the Insured Equipment was purchased is located. In the case of purchase of Insured Equipment from an Insured Website, the law of the United Arab Emirates shall apply and disputes shall be resolved in the courts of Dubai. Any disputes under this Insurance shall be submitted to the courts of the Covered Territory where the Insured Outlet where the Insured Equipment was purchased is located.
This Insurance does not cover:
Loss, such as lost, forgotten/misplaced/left unattended, simple theft where forcible entry has not occurred or violence used.
Theft of all nature.
Loss due to Intentional act or wilful neglect.
Loss arising after 12 months from date of purchase.
Any loss due to hire or loan of the Insured Equipment to a third party or if ownership is transferred.
Loss arising due to unlawful act including terrorist activity.
Any loss if the Insured Equipment is not connected to any cellular network of service provider (applicable for mobile handsets only).
Consequential loss of any kind or description including wear and tear, manufacturing defects etc.
Loss caused by incorrect storage, poor care and maintenance, careless use, incorrect installation, incorrect set-up and neglect.
Loss that is covered by a supplier, dealer or factory warranty.
Any loss of data or software installed or available with the original Insured Equipment.
Any loss arising outside the Covered Territory.
Any loss which is cosmetic in nature and does not result in to complete stoppage of/ the functioning of the Insured Equipment.
Any loss effecting a SIM card, accessories, ancillary products etc. even if the Insured Equipment is completely prevented from working.
Any consequence of war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war rebellion, revolution, insurrection, mutiny, riot, strike, lock out, civil commotion, military or usurped power, acts of a group of malicious persons or persons acting in behalf of or in connection with any political organization, conspiracy, confiscation, commandeering, requisition or destruction of or damage to property by order of any government de jure or de facto or by any public authority.
Any consequence of nuclear reaction, nuclear radiation or radioactive contamination.
Any electrical or mechanical breakdown of the Insured Equipment.
Any damage to the Insured Equipmentcaused by a natural catastrophe, atmospheric or climatic conditions, fire, normal wear and tear, manufacturing defects, vermin or insects.
Losses due to Force Majeure (being understood to be an inevitable, unforeseeable and external event), that precludes the physical recovery of the Insured Equipment.
Any damage or financial loss suffered bythe Beneficiary/Userduring or after accidental damagetotheInsured Equipment.
Total Loss: –
Compensation for any total loss claims will be by way of replacement of the Insured Equipment with the same or similar unit only, costing an amount equivalent to the Purchase Price, subject to depreciation depending on the age of the Insured Equipment (calculated from the date of purchase).
Partial Loss: –
Compensation for any partial loss claims will be only on a repair basis, to the Insured Equipment, by designated insured service centres only. The maximum amount covered shall be the cost of repair, subject to any excess. If the repair cost or maximum liability exceeds the total loss settlement amount at the time of loss, the Program Administrator/Coordinator shall settle the claim on total loss basis in accordance with A) above.
If the repair or replacement value of the Insured Equipment exceeds the Sum Insured, the Beneficiary/User shall bear the difference between the repair or replacement value and the Sum Insured.
Compensation approved for replacement of Insured Equipment can be utilised for purchase of the same equipment only. Once the compensation is agreed the replacement equipment shall be obtained from outlets designated by the Program Administrator/Coordinator no later than 15 days from the date of such approval, failing which the claim for replacement shall be forfeited.
Excess is the minimum value which shall be deducted in each and every repair.
The excess applicable for all physical damage repair cases would be 10% of repair cost or 100 SAR, whichever is higher.
Water Damage/Liquid Damage:
The excess applicable for all water/liquid damage repair cases would be 10% of repair cost or 100 SAR, whichever is higher.
In case of total loss, a depreciation amount shall be deducted from the amount payable to the Beneficiary/User. The depreciation amount will be calculated by applying a depreciation percentage against the Purchase Price in accordance with the following table:
Once a replacement has been made (with applicable depreciation) in respect of Insured Equipment, this Insurance cover ceases and does not apply to the replacement equipment.
The Insured and the Beneficiary/User shall:
Take all reasonable steps to safeguard the Insured Equipment.
In the event of loss, declare/disclose all the material facts about the incidence or event.
All parties agree that in the event of a loss, if there are any misrepresentations, mis-description or non-disclosure of any material facts significant to the admission of liability and assessment of loss then all benefits under this Insurance shall be forfeited in full.
In the event of loss the Insured or Beneficiary/User is required to take the following steps:-
An immediate notice (no later than 48 hours from the time of loss) about the loss should be given to Axiom Service Centre.
All claim related documents or correspondence shall be submitted to Axiom Service Centre and all such original documents or correspondence should reach the Program Administrator/Coordinator no later than 15 calendar days from the date and time of the event of loss.
The damaged Insured Equipment should not be repaired unless notified to the Axiom Service Centre and authorized by The Program Administrator/Coordinator.
Note - If the estimate of repairs is more than SAR 1500/-, a surveyor may be deputed for assessing the loss at the discretion of the Program Administrator/Coordinator.
All claim related queries, reporting a claim and submission of claim document/s or correspondence should be directed to the Axiom Service Centre and GAS – AXIOM Helpline, via Axiom and/or the GAS Call Centre.
Per Repair: - Liability for any one repair shall in no event exceed the Purchase Price..
Aggregate: - The total of all benefits paid or payable during the coverage period under this insurance plan shall not exceed the Purchase Price.
Coverage under this Insurance is subject to the plan selection, payment of relevant charges and premium and signature of the Insured’s authorised representative. Absence of any of the above may result in dis-qualification of the claim and any fraudulent act will invalidate all benefits under this plan.
